Terms of Service

1. Agreement to Terms

By accessing or using the Biofuel Industries Pte. Ltd platform ("Platform"), operated by Biofuel Industries Pte. Ltd ("Biofuel Industries Pte. Ltd", "we", "us", or "our"), located at 22 Tuas Ave 2, Singapore 639453, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

2. Description of Service

Biofuel Industries Pte. Ltd provides a digital platform for the management of excavated earth materials, including but not limited to:

• Automated weighbridge and vehicle identification services
• Quality control (QC) inspection and material classification
• Digital transaction records and billing
• Prepaid credit account management
• Company portal for balance, transaction, and ledger visibility
• Barge logistics coordination and scheduling

3. Account Registration

To use the Platform, you must register for an account through our onboarding process. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Prepaid Credits and Payments

The Platform operates on a prepaid credit system. You must maintain a sufficient credit balance to use our services. Key terms:

• Credits are purchased via our integrated payment gateway (Airwallex) and are denominated in Singapore Dollars (SGD).
• Transaction charges are automatically deducted from your credit balance based on the disposed weight of materials and the applicable rate per kilogram.
• Credit withdrawal requests are subject to admin review and approval. Approved withdrawals will be refunded to the original payment method where possible.
• Overdraft facilities, if granted, are at our sole discretion and may be revoked at any time.
• All payments are final. Disputes must be raised within 7 days of the transaction date.

5. Weighing and Transactions

All vehicles entering the facility are subject to weighbridge measurement and automatic number plate recognition (ANPR). Transaction calculations are based on the difference between entry and exit weights. By using our facility, you agree to:

• Ensure all vehicles are properly registered on the Platform prior to entry.
• Comply with all QC inspection requirements and material classification decisions.
• Accept that weight measurements from our calibrated weighbridge equipment are authoritative for billing purposes.
• Not tamper with, obstruct, or interfere with any weighing, imaging, or identification equipment.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws and regulations.
• Dispose of hazardous, toxic, or prohibited materials without proper declaration and authorization.
• Attempt to gain unauthorized access to the Platform, other accounts, or our systems.
• Misrepresent vehicle registrations, license plates, or company associations.
• Interfere with or disrupt the Platform's infrastructure or other users' access.

7. Intellectual Property

The Platform, including all content, features, and functionality, is owned by Biofuel Industries Pte. Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Platform without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Biofuel Industries Pte. Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Biofuel Industries Pte. Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account and access to the Platform at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, any remaining credit balance will be refunded to you after deducting any outstanding charges, subject to our standard withdrawal process.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform with a revised "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Singapore.
